These Terms and Conditions set out the basis on which Waste Clearance Wimbledon provides waste collection and clearance services to residential and commercial customers. By booking a service, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you should not place a booking.
In these Terms and Conditions, the following expressions have the meanings set out below:
Customer means the individual, business, or organisation requesting our waste clearance or collection services.
Company, we, us, or our means Waste Clearance Wimbledon, the service provider.
Services means any waste clearance, rubbish removal, or related collection services provided by the Company.
Waste means any items, materials, or rubbish for collection and disposal as part of the Services, subject to applicable laws and these Terms and Conditions.
Contract means the agreement between the Customer and the Company formed in accordance with these Terms and Conditions.
The Company provides waste clearance and collection services within our designated service area, including household waste removal, bulky item collection, garden waste removal, and non-hazardous commercial waste services. The precise nature of the Services to be provided will be as set out in the booking confirmation sent to the Customer.
The Company reserves the right to refuse to remove any item that we reasonably believe is hazardous, prohibited by law, not as described at the time of booking, or unsafe to handle or transport.
Bookings can be made by telephone, email, or any other method clearly offered by the Company. When requesting a booking, the Customer must provide accurate and complete information, including:
a. Name and contact details.
b. Service address and access details.
c. Description and approximate volume or weight of the waste.
d. Any special instructions, including parking restrictions, limited access, or time constraints.
Based on the information provided, the Company will give an estimated quote and propose a date and time window for the collection. The booking is not confirmed until the Customer accepts the quotation and the Company issues a booking confirmation. The Company may require a deposit at the time of booking.
The Customer is responsible for ensuring that the information provided is accurate. If, on arrival, the waste is significantly different in volume, type, or nature from that described, the Company may revise the quotation, apply additional charges, or refuse to carry out some or all of the Services.
The Customer must ensure that adequate access is available for our staff and vehicles to carry out the Services safely and efficiently. This includes arranging, where necessary, suitable parking and any required permits. If parking fees are incurred as a result of providing the Services, these may be charged to the Customer as an additional cost.
If the Company is unable to access the property or waste due to incorrect information, locked gates, obstructed entry, or any other reason beyond our control, we may charge a missed appointment fee or a reasonable call-out charge to cover our time and costs.
The Customer must ensure that:
a. Waste for collection is clearly identified, accessible, and ready for removal at the agreed time.
b. The waste does not contain hazardous substances or prohibited items, unless specifically agreed in writing in advance.
c. Fragile, sharp, or dangerous items are safely contained and identified.
d. There is a responsible adult present during the scheduled collection time if access to inside areas is required.
The Customer warrants that they have authority to arrange the removal of the waste from the property and that the waste does not belong to any third party without consent.
Prices for Services are generally based on the volume, type, and weight of waste, as well as the labour and time required. Any quotation given before the waste is seen is an estimate only and may be subject to adjustment on site. The final price will be confirmed before the work is carried out.
Where the Customer has under-described the waste or failed to disclose relevant information regarding access or conditions, the Company reserves the right to revise the quotation. If the Customer does not accept the revised price, the Company may cancel the Service and charge a reasonable call-out fee.
All prices quoted are exclusive of any applicable taxes unless expressly stated otherwise. Any additional charges reasonably incurred for parking, disposal of specific items, or extra labour will be notified to the Customer where possible.
Unless otherwise agreed in writing, payment is due on completion of the Services. The Company may accept payment by cash, card, bank transfer, or any other payment method we make available. Business and commercial customers may be offered account terms subject to satisfactory credit checks and agreed written terms.
Where a deposit is requested, the booking is not confirmed until the deposit has been received. Deposits are generally non-refundable except where the Company cancels the Service without providing an alternative date or where the Consumer Cancellation terms apply as set out below.
If payment is not made when due, the Company reserves the right to charge interest on the overdue amount at the statutory rate and to recover any reasonable costs incurred in recovering the debt.
The Customer may cancel or amend a booking by contacting the Company using the details provided at the time of booking. The following rules generally apply, unless otherwise agreed in writing:
a. If the Customer cancels more than 24 hours before the scheduled collection time, any deposit may be refunded or transferred at the Companys discretion, subject to any non-recoverable costs already incurred.
b. If the Customer cancels within 24 hours of the scheduled collection time, the Company may retain the deposit and may charge a cancellation fee to cover lost time and costs.
c. If the Customer is not present or the Company is unable to access the waste at the agreed time, this may be treated as a late cancellation, and a call-out or cancellation charge may apply.
The Company will endeavour to accommodate requests to change appointment dates or times, subject to availability. Where the Company must cancel or reschedule a booking due to circumstances beyond its control, we will notify the Customer as soon as reasonably possible and offer a new appointment date. The Company will not be liable for any indirect loss or expenses incurred by the Customer as a result of such rescheduling.
The Company will use reasonable endeavours to carry out the Services at the agreed date and time. However, all times given for arrival or completion are estimates only and may be affected by traffic, weather conditions, delays on previous jobs, or other unforeseen events.
The Company will not be liable for any loss, cost, or expense arising from any delay in the performance of the Services, provided we use reasonable care and skill in attempting to meet the agreed timeframe.
The Company operates in accordance with applicable UK waste management legislation and regulations. We will only transfer and dispose of waste at duly authorised and licensed facilities. On completion of the collection, the Company assumes responsibility for the waste and will handle it in accordance with our legal obligations.
The Customer must not request the removal of waste that includes materials for which special licences or permits are required, such as certain hazardous or clinical wastes, unless prior written agreement is obtained and appropriate arrangements are made.
The Customer agrees to cooperate with any reasonable request for information required to comply with waste transfer and duty of care requirements, including the description of waste and its origin.
Without prior written agreement, the Company does not accept the following types of waste:
a. Hazardous or toxic substances, including but not limited to chemicals, solvents, asbestos, certain paints, oils, or gases.
b. Clinical or medical waste, sharps, or biological materials.
c. Explosives, pressurised containers not declared in advance, or any items that present a safety risk to staff or the public.
If such items are discovered among the waste presented for collection without prior disclosure, the Company may refuse to remove them, may suspend the Service, and may apply additional charges for safe handling or specialised disposal.
The Company will exercise reasonable care and skill when providing the Services. However, the Company will not be responsible for:
a. Normal wear and tear or superficial damage to items or surfaces reasonably incidental to the performance of the Services.
b. Damage resulting from pre-existing defects, weakness, or instability in the property, structure, or items being removed.
c. Any loss or damage arising from inaccurate or incomplete information supplied by the Customer.
The Companys total liability to the Customer for any loss or damage arising out of or in connection with the Contract, whether in contract, tort, or otherwise, shall be limited to the total price paid or payable for the Services in question, except in cases where liability cannot be limited or excluded by law.
Nothing in these Terms and Conditions excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be excluded under UK law.
The Customer is responsible for ensuring that no items of value are included in the waste being removed. Once the waste has been collected, it cannot be retrieved. The Company accepts no liability for any loss of items that the Customer has mistakenly included in the waste.
The Customer should clearly separate and identify any items which are not to be removed. The Company will not be liable for any loss where items were not clearly segregated or where instructions given at the property were unclear or contradictory.
The Company maintains appropriate insurance cover for its activities as required by law and industry practice. Details of insurance cover can be provided upon request. Insurance cover is subject to the terms, conditions, and exclusions of the relevant policy.
If the Customer is dissatisfied with any aspect of the Services, they should notify the Company as soon as possible, preferably within 48 hours of completion. The Company will review the complaint, request any relevant information, and seek to resolve the matter promptly and fairly.
In appropriate cases, the Company may offer to re-perform part of the Service, provide a partial refund, or take other steps to address the issue, without prejudice to our legal rights and obligations.
The Company will not be liable for any delay in performing, or failure to perform, any of our obligations under the Contract where such delay or failure is due to events outside our reasonable control. These may include, but are not limited to, extreme weather, road closures, accidents, industrial disputes, public emergencies, or acts of government.
Where a force majeure event occurs, the Company will notify the Customer as soon as reasonably practicable and will seek to rearrange the Services at a mutually convenient time.
The Company will collect and process personal data provided by the Customer for the purposes of managing bookings, delivering the Services, processing payments, and meeting legal obligations. Personal data will be handled in accordance with applicable data protection laws.
The Customer is responsible for ensuring that any personal information provided is accurate and up to date. The Company will not share personal data with third parties except where necessary to deliver the Services, process payments, comply with legal requirements, or with the Customers consent.
The Company may update or amend these Terms and Conditions from time to time to reflect changes in law, regulation, or business practice. The version in force at the time of booking will govern the Contract. Customers are encouraged to review the Terms and Conditions before confirming a booking.
If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful, or unenforceable, that provision shall be severed from the remaining provisions, which will continue to be valid and enforceable.
These Terms and Conditions, together with the booking confirmation and any written variations agreed between the parties, constitute the entire agreement between the Company and the Customer and supersede all previous agreements, understandings, or representations, whether written or oral, relating to the subject matter of the Contract.
These Terms and Conditions and any dispute or claim arising out of or in connection with them, or with the Services provided, shall be governed by and construed in accordance with the laws of England and Wales.
The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services.
